These terms and conditions govern your access to and use of Amazing Troms AS' websites, your rights regarding refunds and cancellations, and risk of participating in our tours/activities.

By accessing or using our sites, you are agreeing to these terms and entering into a legally binding contract with Amazing Troms AS (Norwegian organization number 921 105 096). We suggest reading the terms carefully and understanding the terms and conditions. If you are unwilling or unable to be bound by the terms, do not access or use our sites.

By agreeing terms and policies you also consent to our policies regarding booking and cancellation. You also consent that all our tours and activities you participate in are at your own risk, and understand that there is a risk of injury.

Any references to "you" and "your" refer to you, as the customer and user of the site. References to "we", "us" and "our" refer to Amazing Troms AS.
We may refer to "Users", meaning our customers who use our Services, including visitors to our sites.

Terms of Service

1. CHANGES IN TERMS AND CONDITIONS

We may modify the terms and conditions as we wish from time to time. When we do make changes, we will notify you with an announcement bar that will be shown for one week continuously. You understand and agree that your continued use of the site after any new modifications to the terms indicates that you accept the modifications made.

2. GENERAL

www.amazingtroms.com is owned by Amazing Troms AS.. All rights for information and images on the site are reserved for Amazing Troms AS.

3.1 USING THE SITE

We grant you permission to use the site subject to the restrictions in these terms. We may terminate your permission to use the site for any conduct that we consider to be inappropriate, or if you breach these terms. Your use of the Site is at your own risk, including the risk that you might be exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate.

3.2 SITE AVAILABILITY

All sites owned by Amazing Troms AS may be modified, updated, interrupted, suspended or discontinued at any time, for any or no reason, without notice or liability to us.

4. RESTRICTIONS

The following rules, policies, and disclaimers shall apply to and/or govern your use of the Site.

You age not to, and will not assist, encourage, or enable others to use the site to:

A – Engage in commercial activity (including, but not limited to, sales, contests or sweepstakes) without Amazing Troms' prior written consent.
B – Solicit, request, or collect personal information for commercial or unlawful purposes.
C – Send bulk emails, surveys, or do other mass messaging under any circumstances.
D – Restrict or inhibit any other user from using and enjoying the Site (for example, by means of hacking or defacement).
E – Utilize any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape or index any portion of the Site.
F – Remove or modify any copyright, trademark, or other proprietary rights notice that appears on any portion of the Site or on any materials printed or copied from the Site
G – Attempt to gain unauthorized access to the Site, user accounts, computer systems or networks connected to the Site through hacking, password mining or any other means.
H – Use any device, software, or routine that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the Site.

5. PRIVACY POLICY

Use of all our sites is also governed by our Privacy Policy, which is incorporated into these Terms of Service. You will find our privacy policies further down on this site.

6. THE ORDERING PROCESS

We reserve the right to cancel parts of, or your entire order, if products are sold out or activities and tours are overbooked. If a product is sold out or an activity is overbooked you will get a message containing information about this. In the case of an eventual cancellation of your order made by us you will get your payment refunded.

7. PRICES

All prices are in Norwegian Kroner (NOK). The total cost of your order will be shown before your order is placed. The total cost will include taxes, eventual shipping, and all other costs. Prices are set by our staff and are subject to change at our will.

8. PAYMENT

Prepayments are made through Acuity Scheduling's payment system with either a credit card, debit card or paypal. When your payment is verified, the order will proceed. That some tour payments are made at the tour's card terminal.

9. COPYRIGHT OF SITE

All information, images, videos, graphics and other media are owned by Amazing Troms AS. Any attempts of copying, duplicating, selling, publishing or exploiting our content without written confirmation by us will be reported.

10. THIRD PARTIES

Our Site may include links to other websites or applications (each, a “Third Party Site”). Unless otherwise noted, we do not operate, control or endorse any information, products, or services on any Third Party Site. You agree that we are not responsible for the availability or contents of any Third Party Sites and that your use of any Third Party Site is at your own risk.

11. BOOKING AND CANCELLATION

Amazing Troms AS may cancel a tour/activity if the company's policies (informed in booking service) for minimum contestants is not fulfilled. In that case you will be given a full refund.

Amazing Troms AS may cancel a tour/activity due to unforeseen circumstances beyond our control, such as bad weather (not safe at sea), closed roads, low water level in rivers, natural disasters, force majeure, industrial disputes or other events that make it difficult or inadvisable to proceed with the tour/activity. In that case you will be given a full refund.

Amazing Troms AS will by the best of means not overbook a tour/activity. In case of this happening we will give you a full refund or offer you another tour/activity the same or next day.

The right to cancel tours is also valid if the event or deviation occurs on or along the travel route and projects a real risk for the customer.

You can cancel a prepaid or booked tour/activity with a full refund if done so 60 days before the tour/activity is to start/depart.

You can cancel a prepaid or booked tour/activity with a 50% refund if done so 30-60 days before the tour/activity is to start/depart. If canceled closer than 30 days to the activity/tour is to start/depart, the customer has no claim for refund.

If you do not show up at the right time or place set for the tour/activity to start/departure, we will carry out the tour/activity without changing time and place for the customer and will not give a refund.

Cancellations need to be completed through our contact form or email: with reference number, or else they will not be refunded.

Amazing Troms AS does not offer cancellation protection, so we recommend everyone to buy a private travel insurance covering potential cancellation.

12. LOSS OR DAMAGES

We do not cover damages or loss of any private belongings brought on the tour/activity. We recommend everyone to have a private travel insurance covering potential damages or loss of private belongings. You understand that on all our tours/activities there is a risk for electronics and/or other belongings to be damaged by water/sea water, lost at sea or in the river.

OUR PRIVACY POLICY

1.1 PERSONAL INFORMATION

We may collect the following personal information about you:
– Contact information such as name, email address, street address and phone number.
- Billing information such as credit card number, paypal account and billing address.
– Eventual orders and repeated orders.

We or one of our trusted partners may use this information to:
- Send you requested products or service information
- Fulfill your order
- Send you order confirmations
- Respond to customer service requests, questions, and concerns
- Process information submitted with a job application
- Conduct research and analysis

1.2 GENERAL INFORMATION

Through squarespace's analytics system we collect general statistics about our customer base.
We have statistics on the number of unique visitors, page views, and traffic sources. We also have a geographical map of where our customer base is.
We know which sections of our site are most popular and frequently viewed. This is all general information not personalized by any means.
Example: We can know that there are five hundred people who have visited us from Sweden. But we do not know who these 500 people are.

– Popular traffic sources (Google search, social media, eg)
- Popular content and frequently visited sites
- General geography
– Amount of forms late
– Purchase Funnel (Site visited – product viewed – added to card-purchased ratio)

1.3 HANDLING OF YOUR INFORMATION

Your information is handled in a secure way. This is our way of processing your information:
When you order a serivce from our site we may need information such as your name, address, phone number and email address.
The information is saved in conjunction with accounting and eventual rebooking and refunding. Your information is never stored for more than a year. We may and will share information with our trusted partners to provide services such as booking, orders and contact information.

1.4 STORAGE AND ACCESS

All Squarespace sites are hosted across their private cloud with full redundancy. If a primary service fails, they can switch to a backup service. Their Operations team monitors Squarespace sites 24×7 and are ready to respond to incidents within minutes of detecting an anomaly.
Your information is stored in multiple Tier III data centers across the United States. Squarespace saves images and other static assets via multiple geographically
distributed content delivery networks (CDNs). This system ensures that the data in each page view is served from the data center closest to the visitor's location.

Your information is normally stored for a maximum of 365 days. After that our information about you will be deleted. Your information can be deleted at your wish.
You have the right to access, correct, delete, and limit the processing of your personal data. You can request our information about you by contacting us.

1.5 SHARING OF YOUR INFORMATION

We only share information with our trusted partners. As of the 17th of June 2019 our trusted partners are Best of Lyngen AS and Acuity Scheduling. Personal information such as first name, last name, postal address, email address and/or phone number is provided to our partners when needed. They need this information to fulfill and schedule your booking. The information may be used as contact information regarding cancellations, rebookings or other necessary matters.

1.6 MONITORING

To help protect you and others, we monitor use of the Sites, and we use the information we collect, including personal information, to identify fraudulent activities and transactions; prevent abuse of and investigate and/or seek prosecution for any potential threats to or misuse of our sites; ensure compliance with the applicable terms of service and this privacy policy; investigate violations of or enforce these agreements; and otherwise to protect the rights and property of Amazing Troms AS, our partners, and customers. Monitoring may result in the collection, recording, and analysis of online activity or communications through our sites. If you do not consent to these conditions, you must discontinue your use of our sites.

1.7 PICTURES/VIDEOS

During our tours/activites/stays our Guides and guests will take pictures/videos. Amazing Troms AS is not responsible for pictures/videos taken by guests/participants or the use of the pictures/videos. Pictures/videos taken by Guides with participant/guest in them, Amazing Troms AS can use for advertising or social media purposes, if not otherwise stated by the guest/participant at the time of the tour/activity.

1.8 COMPLAINTS

If you have any complaints regarding our privacy policies we prefer that you send us a complaint through our contact form first. You can also send a complaint to The Norwegian Data Protection Authority (DPA). Although direct contact with us is preferred.

2. SECURITY

The security of your personal information is really important to us. When entering personal information to our forms, the transmission of the information is encrypted
using a secure socket layer technology known as SSL. If you choose to use a third party payment option to pay for your order (eg paypal),
its privacy statement and security practices will apply to your information. We encourage you to read that privacy statement before providing your information.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and after receipt.
However, no method of transmission over the Internet or method of electronic storage is 100% secure and we cannot guarantee its absolute security.

3. ADDITIONAL

Children – We do not attempt to collect any personal information on people under the age of 15. If you feel that we have unknowingly collected information from someone under the age of 15, please contact us immediately and this information will be removed.

Other sites – Our sites do include links to other sites who have different privacy policies than us. If you share your personal information with any of these sites, your information is handled by them and governed by their policies. We encourage everyone to always read the privacy policy of any site they visit.

4. CHANGES IN PRIVACY POLICY
